between gains and losses today as the fiscal cliff negotiations once again are a focus for investors. right now the dow is up roughly 35 points. a new survey shows plans by small businesses to hire workers fell to their lowest level in three years last month. according to the quarterly wells fargo/gallup small business index survey, 21% of small business owners plan to cut payrolls while only 17% plan to boost hiring. the survey comes just one day ahead of the labor department's big monthly jobs report. sales of homes facing foreclosure jumped 22% in the third quarter outpacing sales of bank-owned homes. the latest data reflects increased efforts by lenders to avoid foreclosing on homes with unpaid mortgages. short sales accounted for 65% of properties in some stage of foreclosure. we continue our "countdown to the closing bell" with liz claman. ♪ liz: see, adam used to -- something's wrong, because he used to say with the woman who, dot, dot, dot, loves the cleveland -- >> i'll go back to that. i'll make fun. i'll have fun with you. on the fiscal cliff negotiations, but let's art in chicago with john, two very interesting situations continuing, drama over the fiscal cliff in d.c. and also this week we have the fed meeting. which is more important to the market? >> eventually it will be the fiscal cliff that is more important to the market, but make no doubt about it, the fed meeting with the announcement wednesday morning and wednesday afternoon is going to continue to support risk assets. you were talking about how the dollar is melting up for the fourth consecutive day. the federal reserve will make a very active effort to continue to support risk assets. whether they're equities or commodities. the metals market had a very positive day, recovering a bit with the damage done last week. risk assets are doing well, but over the fiscal cliff for sure in december. liz: the fed, the fed, the fed. they're not going to do anything, but they might announce some sort of easing that is what we constantly talk about and wonder because that has been the trade. with it had a decent rally, the market up double digits the past year and

limiting the charitable tax deduction asart of the fiscal cliff negotiation will this year be any different? we have the head of charity navigator with me now. ken, we were talking during the break, there has been, you've seen increasing contributions to charities this year because of that fiscal cliff. what do you see? we've seen some larger charities have seen as much as or 8% increase in donations whereas some of the smaller charities they're still struggling and donations are somewhat level from last year. gerri: you know, people have this on the front of mind. this is traditional time of year you make your contributions and this year more than ever i think people are thinking their dollar will go further because of the possible changes in taxes. what is the one thing you would tell folks this year about chartable giving? what do they need to think about or remember this year? >> they need to remember that even now more than every charities really need their help. there is more of a demand because of unemployment, because of other challenges out there, disasters and storms and so forth.

, vis-a-vis the president on how to avoid the fiscal cliff or what we should do about tax increases and spending cuts. if mr. boehner is the principal negotiator, what he had to say lasted all of 30 seconds. he simply came out and said look, if the president doesn't agree with our plan, the republican plan, he should submit a plan that could pass through congress. he has failed to do that. he said, however, and he used these words, that speaker boehner and the republicans are ready and eager to negotiate with the president. doesn't sound like there's any degree of compromise there. there's an extremely short statement, really didn't say much of anything. that's it, speaker boehner. mr. cantor is now speaking. again, he's keeping it very very short and very much to the point. but the principal negotiator had all of 30 seconds. that's it. we brought it to you live. >>> back to the judge. >> well i was sort of hoping he would say no new taxes no new spending no new borrowing, draw a line in the sand, do what you were sent there to do. they are becoming enablering of obama -- they are b

boehner saying the president has to get serious about the fiscal cliff talks. dennis: rich edson with the latest from there. >> as we have been reporting, democrats and republicans are stuck on these negotiations. a few moments ago house speaker john boehner hit the floor and confirmed just that. >> i want people to know that the president and i met on sunday. it was a nice meeting, cordial but we're still waiting for the white house to identify what spending cuts the president is willing to make as part of a balanced approach to the american people. where are the president spending cuts? the longer the white house slow walk the process, the closer our economy gets to the fiscal cliff. herhere's what we do know. we know the president wants more stimulus spending and an increase in the debt limit without any cuts for reforms. that is not fixing our problem, frankly, it is making it worse. on top of that, the president wants to raise tax rates on many small-business owners. but even if we did exactly what the president wants, we would see red ink for as far as the eye can see. that
